순환골재 유해성 평가
법률에 의해 순환골재를 생산 및 공급하려는 자, 사용하려는 자는 공급과 사용 전, 후 토양오염우려기준 적합여부를 확인하여야 합니다.
건설공사현장에서는 순환골재의 품질기준 준수 이외에도「토목공사표준시방서」,「건축공사표준시방서」등 국토교통부 관련 지침 및 기준 등에 따라 시공관리 하여야 하며, 순환골재 사용 전에 안정성 여부 등 현장조건에 대하여 충분한 조사를 실시한 후 환경오염우려가 없다고 판단되었을 경우에 사용하여야 합니다.
순환골재 등의 재활용에서 순환골재를 생산·공급하는 자는 사용자가 요청하는 사용 용도별 품질기준에 적합한 순환골재를 생산·공급하여야 하므로, 사용자에게 공급한 순환골재가 품질기준(국토교통부 고시)과 토양오염우려기준에 적합한 지 여부를 확인해야하고 순환골재 생산·공급 현황을 관리하여야합니다.
아울러, 순환골재를 사용하고자 하는 자는 공급받은 순환골재가 사용하려는 용도별 품질기준(국토교통부 고시)과 토양오염우려기준에 적합한 지를 확인하고 기준에 적합한 순환골재만을 사용하여야 합니다.
건설공사 시 순환골재를 사용하여 설계·시공하는 경우에는 안정성과 환경관련 규정의 적합여부 등의 조사와 확인을 실시하고 순환골재의 특성, 시공방법을 파악한 후 시행하여야 합니다.

건설페기물의 재활용촉진에 관한 법률 제35조
국토교통부장관은 환경부장관과 협의하여 건설폐기물의 재활용을 촉진하기 위하여 순환골재의 용도별 품질기준 및 설계ㆍ시공 등에 관하여 필요한 기준을 정하여야 한다.
건설페기물의 재활용촉진에 관한 법률 제35조의 2
순환골재 및 순환골재 재활용제품을 사용하려는 자(건설공사에서 사용하려는 경우 에는 발주자를 말한다)는 다음 각 호의 사항을 준수하여야 한다.

순환골재 및 순환토사의 품질기준, 품질관리, 토양오염우려기준 확인
건설폐기물의 처리 등에 관한 업무처리지침 (환경부예규 제734호)
건설폐기물의 종류별·처리방법별 분리 배출, 친환경적 적정 처리 및 고부가가치 용도로의 순환골재 등 재활용 활성화를 위한 행정사항을 정하여 업무처리의 일 관성 및 신뢰성 등을 확보하기 위하여 마련

토양오염우려기준 23개 항목 (다이옥신 포함)
국가표준기본법 제23조 제2항
시험·검사기관 인정제도의 확립에 필요한 인정기구와 운영기관의 지정, 인정기 준 및 절차 등에 필요한 사항은 대통령령으로 정한다.
